Germany to Abolish Administrative Visa Appeals from July 1, 2025, Following Successful Pilot
Starting July 1, 2025, the German Federal Foreign Office will officially abolish the remonstration procedure for visa rejections worldwide. This move eliminates an informal legal remedy that was not mandated by law but had been voluntarily offered to visa applicants as an accessible form of administrative appeal.
Judicial Appeals to Replace Remonstration Process
Following the change, applicants who are denied a visa will only be able to pursue a formal judicial appeal, a process that is more expensive, complex, and time-consuming, often taking up to two years to reach a decision. In contrast, the administrative appeal (remonstration) typically required around three months, offering a faster and more affordable option. Experts anticipate a drop in appeal submissions once the new rules take effect.
Decision Based on Pilot Project Outcomes
The decision was made following a pilot project launched on June 1, 2023, in several German visa sections, where the remonstration process for both Schengen and national visas was temporarily suspended. The evaluation of the pilot showed that visa centers were able to reallocate staff resources, process more visa applications, and reduce waiting times compared to previous years.
According to the Foreign Office, these operational improvements benefit all applicants, as staff can now focus more efficiently on application reviews and consular services.
High Volume of Visa Applications and Rejections
Germany continues to handle a substantial number of visa requests. Germany received 1,459,560 visa applications in 2023, of which 208,155 faced rejection. The removal of the remonstration option could significantly impact how applicants respond to visa denials going forward.
